Terms of Use
Effective date: October 11, 2026
These terms apply to your use of FirstDayTraining.com (the “site”), which is owned and operated by Todd Allyn Media Inc. (“we,” “us”). By using the site, you agree to these terms. If you don’t agree, please don’t use the site.
Important: The information on this site may contain mistakes. It is general education only, not legal, medical, engineering or other professional advice. Always follow your employer’s safety program, the manufacturer’s instructions and the current official regulations.
1. Educational information only
The site gives general safety, health and workplace-rights information for educational purposes. It is not legal, medical, engineering, financial or other professional advice, and using it does not create an attorney-client, employer-employee or any other professional relationship with us. For advice about your own situation, talk to a qualified professional, your employer’s safety staff, your union or the agency responsible for the rule.
2. The information may be wrong or out of date
We work hard to make the site accurate, but we are human and we can make mistakes. Laws, regulations, consensus standards, product instructions and best practices change often and differ from state to state and site to site. Some information on the site may be incomplete, out of date, simplified or incorrect, and links to outside sources may stop working. We do not guarantee that any information is accurate, complete, current or right for your situation. Always check the official source, such as the current text of the regulation, before relying on anything you read here.
If you find an error, please tell us at support@toddallynmedia.com so we can fix it.
3. Not a substitute for required training
The site does not replace your employer’s written safety program, site-specific training, hands-on training, training required by OSHA or your state, the manufacturer’s instructions, or the judgment of a competent or qualified person on your site. Reading pages or marking topics complete does not certify, license, qualify or authorize you to do any task. The site is not an OSHA Outreach Training Program (10- or 30-hour) course.
Certificates of completion printed from the free topics on the site, including numbered certificates that can be checked on our verify page, only show that a person completed a free, self-paced online awareness topic and passed its short quiz on the date shown. They are not an OSHA card, license, certification or proof that any training required by law or by an employer was given. We don’t check the identity of the person who took the quiz.
4. Your responsibility
You are responsible for how you use the information on the site and for following all laws and workplace rules that apply to you. Many of the activities described on this site are dangerous. If something is not safe or you are not sure, stop and ask a supervisor or competent person. In an emergency, call 911.
5. No warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
6. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TODD ALLYN MEDIA INC. AND ITS OWNERS, EMPLOYEES, CONTRIBUTORS AND PARTNERS WILL NOT BE LIABLE FOR ANY INJURY, ILLNESS, PROPERTY DAMAGE, LOSS, PENALTY, FINE OR OTHER DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY INFORMATION ON IT, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. Some states don’t allow certain limitations, so some of these may not apply to you.
7. Indemnity
You agree to defend and hold harmless Todd Allyn Media Inc. from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the site or your violation of these terms.
8. Links to other sites
The site links to government agencies, standards organizations, manufacturers and other outside websites for your convenience. We don’t control those sites and aren’t responsible for their content, accuracy, availability or privacy practices. A link is not an endorsement.
9. Copyright and permitted use
All content on the site, including text, page designs, graphics and the site’s organization, is © Todd Allyn Media Inc. and protected by copyright law. Quoted regulations and linked government materials remain public or belong to their owners.
- You may view, print and share pages for personal use or non-commercial safety training, such as a toolbox talk, as long as you don’t change the content and you keep the copyright notice and a link to FirstDayTraining.com.
- You may not copy, republish, sell, scrape or build products from the content, or use it on another website or in paid training, without our written permission. To ask, see custom training for organizations or email us.
10. Names and trademarks
Names of agencies, standards bodies, products and companies (for example OSHA, ANSI, NFPA and tool brands) belong to their owners and are used only to identify them. We are not affiliated with, endorsed by or speaking for OSHA, the U.S. Department of Labor or any state agency.
11. Your suggestions
If you send us topic requests, corrections or other ideas, you allow us to use them to improve the site without owing you anything. Don’t send anything confidential.
12. Accounts
Accounts are free, and you need one only to sync your progress, earn numbered certificates or buy a course. If you create one, you agree to give your real name and an email address you control, to keep your password private, and not to share your account or let someone else take quizzes for you. You’re responsible for activity on your account. We may suspend or delete accounts that break these terms, that are used to misrepresent training, or that are never confirmed, and we may revoke certificates that were obtained improperly. You can delete your account at any time on the My Account page. Our Privacy Policy explains how account information is handled.
13. Paid courses, payments and refunds
Besides the free pages, we offer a small number of paid, self-paced online courses. These extra terms apply to them.
- What you get. A one-time purchase gives your account access to one course (lessons, module quizzes, a final exam and a certificate of completion if you pass). There is no subscription and we never charge you again for the same course. Access lasts as long as your account stays open and we continue to offer the course. Access is for you only; please don’t share your account or the course content.
- Prices and payment. Prices are in U.S. dollars and shown before you pay. Payments are processed by PayPal. You pay on PayPal’s secure window, we never see or store your card or PayPal login details, and PayPal’s own terms and privacy statement apply to the payment. Prices may change at any time, but the price you were shown when you paid is the price you paid. You need a free account on this site to buy a course.
- Refunds. If you are not satisfied, email support@toddallynmedia.com within 7 days of your purchase for a full refund, as long as you have completed less than 25% of the course and have not earned its certificate. After that, purchases are not refundable except where the law requires it or where a problem on our side keeps you from using the course and we can’t fix it. Refunds go back to the original PayPal payment, and your access to the course ends when a refund is issued. Please contact us before opening a payment dispute so we can sort it out quickly.
- Course certificates. A course certificate shows only that the named person completed that online course and passed its exam on the date shown. It is not an OSHA 10 or 30 card, a license, a government or FAA certification or approval, or proof that training required by law or an employer was given. Our FAA Part 107 course is a study aid; it is not FAA-approved training and does not give you the FAA remote pilot certificate, which you must earn by passing the FAA knowledge test.
- Course content. Course lessons are copyrighted (see section 9) and may not be copied, recorded, shared or resold. We may update, reorganize or retire courses.
14. Acceptable use
Don’t misuse the site. That includes trying to break or overload it, gaining unauthorized access, using automated tools to copy large amounts of content, creating accounts automatically, or trying to get certificates without taking the quizzes.
15. Changes
We may update the site and these terms at any time. The current version will always be posted here with its effective date. Continuing to use the site after a change means you accept the updated terms.
16. Governing law
These terms are governed by the laws of the United States and of the state where Todd Allyn Media Inc. has its principal place of business, without regard to conflict-of-law rules. If any part of these terms is found unenforceable, the rest stays in effect.
